Please read these terms carefully before using Forge Fitness. By using the app, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Forge Fitness ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of Service

Forge Fitness provides AI-generated fitness coaching, personalized workout plans, HRV readiness tracking, nutrition logging, and related health and fitness tools. The Service is provided "as is" and is intended for informational and motivational purposes only.

3. Health and Medical Disclaimer

Consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have pre-existing medical conditions, injuries, or concerns
The workout plans, HRV interpretations, and nutrition guidance provided by Forge Fitness are generated by artificial intelligence and are not a substitute for professional medical or fitness advice
You exercise and follow nutritional guidance entirely at your own risk
Forge Fitness is not liable for any injury, illness, or adverse outcome resulting from use of the Service

4. Eligibility

You must be at least 16 years of age to use Forge Fitness. By using the Service, you represent that you meet this requirement. Users aged 16–18 should obtain parental or guardian consent before using the Service.

5. Subscription and Billing

Free trial: New subscribers receive a 14-day free trial. Your payment method will be charged at the end of the trial period unless you cancel beforehand.
Yearly plan: $59.99 billed annually ($4.99/month). Renews automatically each year.
Monthly plan: $17.99 billed monthly. Renews automatically each month.
Cancellation: You may cancel at any time through your Stripe billing portal or by contacting us. Cancellation takes effect at the end of the current billing period.
Refunds: We offer a 30-day money-back guarantee. If you're not satisfied within 30 days of your first paid charge, contact us for a full refund.
Price changes: We reserve the right to change subscription prices with 30 days' notice to current subscribers.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, scrape, or abuse the API endpoints
Share account access with others
Use automated tools to generate excessive API requests
Attempt to circumvent rate limits or payment requirements

7. Intellectual Property

All content, design, branding, and software in Forge Fitness is owned by Forge Fitness and protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the Service without express written permission.

Workout content generated by the AI on your behalf is provided for your personal use only.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Most of your health and fitness data is stored locally on your device and is never uploaded to our servers.

9. Limitation of Liability

To the maximum extent permitted by law, Forge Fitness and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or property damage, arising from your use of the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that:

The Service will be uninterrupted or error-free
AI-generated workout or nutrition content will be accurate or appropriate for your individual needs
HRV readiness scores will accurately reflect your physiological state

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will notify active subscribers of significant changes.

12. Termination

We reserve the right to terminate or suspend your account for violation of these Terms. You may terminate your account at any time by cancelling your subscription and clearing your local data.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Forge Fitness is registered. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, via email or in-app notice. Continued use of the Service after changes constitutes acceptance.

Prices listed are in AUD. GST is not applicable (below the $75,000 AUD registration threshold). Once this threshold is reached, prices and billing will be updated accordingly with 30 days' notice.

Refunds: To request a refund within our 30-day guarantee, email legal@fxrgeai.com with your account email. Refunds are processed within 5–10 business days to your original payment method. The 30-day period begins from the date of your first paid charge (after any free trial).
